These terms and conditions govern your use of our Flishr. If you do not agree with these conditions please do not use Flishr software and service.

3. License to use Flishr

It is against our terms of service to upload, share or distribute adult content, illegal content or copyrighted content without the consent of the copyright holder. Any content that would be considered rated R, explicit or pornographic is not appropriate for use with Flishr.

4. Disclaimer

This service is provided “as is.” We make no representations or warranties of any kind, express or implied, as to the operation of this software or the information, content, materials, product descriptions or products included on it. You expressly agree that your use of this site and service is at your sole risk.

To the full extent permissible by law, we disclaim all warranties, express or implied. We do not warrant that the product or other content is accurate, complete, reliable or error-free.

Under no circumstances shall we be liable on account of your use or misuse of Flishr. We cannot be held liable for the accidental loss of photos or data on the software, or the copying of photos or data by its users.

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages.

We are not even liable for what purposes the downloaded photos would be used. If someone downloads some photos from resources such as Flickr, it is his/her sole responsibility not to market or sell the copyrighted photos and we do not follow and urge people not to use or download them.

5. Privacy

We will store your account information for billing and contact purposes on a secure server. We may make updates to our software and services to further protect your privacy. The content of your photos may be processed by a computer for facial recognition, detection of content or extraction of additional meta-data in future versions. Information collected will remain private and may be used to further enhance our services.

You agree to indemnify and hold us, our affiliates, directors, officers, agents, employees, service providers, and suppliers harmless from any dispute that may arise from your breach of these Terms of Service or violation of any representations or warranties contained in these Terms.
